These Terms of Use ("Terms") govern your access to and use of the website at agdmarine.com and its tools and forms (the "Site"), operated by Atlantic & Gulf Dredging & Marine, LLC ("AGDM," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site's public pages are open to anyone. Certain areas (the employee/office tools at /tools/, onboarding, and similar) are restricted to authorized AGDM personnel and invited individuals, and may only be accessed by those to whom access is granted.
Some forms let you submit information or upload files (for example, the careers, contact, vendor-registration, and onboarding forms). When you submit or upload, you represent that: (a) the information is accurate and you are authorized to provide it; (b) the files are free of malware and do not infringe anyone's rights; and (c) you are not submitting anyone else's personal or confidential information without authority to do so. You grant AGDM permission to store and use your submission for the purpose for which it was provided (e.g., evaluating an application, considering a vendor, or completing employment paperwork). SMS messaging is governed by our SMS Program Terms. We do not send marketing texts. Reply STOP to any message to opt out.
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete or current. Statements about past projects and capabilities are provided for general information and are not a guarantee of future results.
To the fullest extent permitted by law, AGDM and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
The Site, its text, graphics, logos, and photographs are owned by AGDM or its licensors and are protected by law. You may not copy, reproduce, or use them without our written permission, except as needed to use the Site for its intended purpose.
You agree to indemnify and hold AGDM harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Martin County, Florida, and you consent to their jurisdiction.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Site after a change means you accept the revised Terms.
